India Introduces New Rent Rules for 2025: Stronger Protection for Tenants and Clear Rights for Landlords

The Government of India has announced major updates to rental laws under the Model Tenancy Rules 2025, aiming to make renting more fair, transparent, and secure for both landlords and tenants.
The new rules introduce limits on deposits, mandatory digital agreements, and clear procedures for rent increases and eviction.
Here are the key highlights:
🔹 1. Security Deposit Cap
Landlords can now charge no more than two months’ rent as a deposit for residential properties.
🔹 2. No Forced Evictions
Tenants cannot be removed without a legal process. Quick verbal eviction notices or pressure tactics are not allowed.
🔹 3. Mandatory Digital Registration
All rental agreements must be digitally stamped and registered online within 60 days, making them legally enforceable.
🔹 4. Rent Increase Rules
Rent can be revised only once every 12 months, and landlords must give a 90-day written notice before increasing it.
🔹 5. Entry Notice Requirement
Landlords must give at least 24 hours’ written notice before entering the property for inspection or repairs.
🔹 6. Repair Responsibility
If a major repair is needed, tenants must notify the landlord.
If no action is taken within 30 days, the tenant can get the repair done and deduct the amount from rent.
🔹 7. Harassment is Punishable
Actions like changing locks, cutting electricity or water, threats, or intimidation are now punishable under the new rules.
The 2025 changes aim to modernize India’s rental market, reduce disputes, and encourage more homeowners to rent out vacant properties with confidence — while ensuring tenants’ rights are protected.
